Legal Question in Family Law in California
Child support
The mother of a child who I had an affair with is claiming that she has a baby by me. She has said that she will send the DA after me if I don't pay support. Can she just say I am the father without any proof and if it is my child will my wife's income be calculated in the child support?

She will have to file a complaint with D.A. you will then be served with a Pet to Establish paternity. At that time you will need to respond requesting DNA testing. If it is found that you are father, support my start from date D.A. filed. No your current wife's income is not included in caluc. please call our office with questions. Don't pay until paternity is established. The DA will pay for DNA testing. You can arrange it yourself, if you like. Cost: about $600
