Legal Question in Family Law in California

child support

I would like to know if the non custodioal parent can use child care expenses towards their current child support order, if they don't have proof of expenses. And if they don't have the child during the week only on weekends, but claim that they have to pay each month to hold the spot at the daycare. Also if the daycare center say's that their is no charge to hold the spot for the child. I recently had a court date where the non custodial parent stated that he pays for childcare, but i have the child monday thru friday and the non custodial parent was able to get his child cupport reduced to zero because of this fraudulent claim.

Re: child support

Child care expenses are not a part of the court ordered child support. Also Child care costs are deductible only to the extent that it is required for work or in some cases school.
