child support obligation

do i have to pay child support while incarcerated

and never had been served court ordered papers

and still being legally married,also she does not live with our two children and collects welfare while children are living with grandparents i''ve always payed what i owed just this time i fell into hardship and need your advice please help

thank you -helpless in california

Re: child support obligation

An order for child support remains in effect until it is changed. Thus child support will continue to accrue until the court changes it. If you believe that you were not properly served you should file a motion to set aside the order as soon as possible. Along with that motion you should request that child support be set to $0.00, until you are released from prison and get a job.
