Child Support for Offspring of Unwed Mother
Approximately four years ago, my niece parented
a child
out of wedlock. The child's father is a successful
musician/artist based in Los Angeles (where they
lived
at the time), but his relationship with my niece
ended
before the child was born, and he has had
nothing to
do with either of them in the interim. In the
meantime,
although my niece has moved to Delaware and is
now
barely subsisting, she has refused to seek any
child
support payments from the father, stating that she
''was
told'' that she couldn't force him to pay anything
under
the circumstances. I have questioned the
accuracy of
this opinion, but I do not know what the law
provides in
that regard or what her options might be. Does
she
have any recourse in seeking child support from
him?

She can absolutely obtain a child support order. Collection of the order is also easier than it ever has been. She needs to file a paternity action in California. Good Luck, Pat McCrary
