Child Support
I have an order from Illinois that orders child support for my daughter whom lives with her mother in California. California has requested to interstate the order. I just found out that California has been showing me behind and that I show no payment since june of 2005. After contacting Illinois they indicated that I am current and not in arrearage. California has been reporting me for several months to the credit bureaus and I cannot obtain a job in my career field I have experience in(Law Enforcement). Dut to child support being in arrearage. They are auditing my case at my request, but I cant retrieve documentation stating that Im not behind so I can move on in the testing process for other departments. Illinois failed to tell California that they were getting payments and california has been taking taxes that dont belong to them. I need to know my rights. Do I have a case or should I hire an attorney? I am being put through alot of unnecessary bullcrap. I want reimbursed my suffering at the mercy of two states that dont have a clue. Please help.

You need to retain an attorney in California or do it yourself to investigate the California claim that you owe support. A Californai order for support may have been entered against you without your knowledge. That order would not necessarily be satisfied by your payments on the Illinoise order. If this is the case it would necessary for you to file a motion to set aside the California Support order. If there is only the Illinois support order then you would need to get a statement from Illinois that your support is current and present that to the California Court. Then request an order that they stop collecting support. Care must be taken not to confer personal jurisdiction over you to the California court.
