Legal Question in Family Law in California

I have a child support order on a child who is now 19. My ex is working and getting paid under the table. We also have a 14 year old together who was not included in that support order. (he was born after our divorce). How do I establish paternity (for the 2nd child), get a child support order and collect on the standing order if my ex-husband is being paid under the table? I live in San Bernardino County, the original support order is from Los Angeles County.

You are going to need to consult privately, in person, with a competent attorney that handles paternity cases. There are various presumptions that apply, and your ex may or may not be a presumed father. Child support can only be made retroactive at the earliest to the date you file a petition, so I suggest you get moving as soon as possible. The attorney is also going to want to see copies of your divorce paperwork.
