Legal Question in Family Law in California

child support

i over paid 5000.00 of child support this is due to the county of L.A. charging me for areers and taking income taxes and a retirement payment from me for money i never owed. i kept telling them i didnt owe and have always been current. they continued to take the money. finally i received a letter from the county saying that an audit of my account was done and they discovered i have been overcharged by more than $5000.00. can i go after the county to give me back this money that they took from me that was acually never owed and for the all i had to endure each time a garnishment letter would be sent to my employers over the years pretty much saying that i was DEADBEAT DAD, not a loving father not a person of integrety and caring of my childrens needs. i sufferd alot of anguish over the years because of this no believing me that i didnt owe and i would never do that to my children. i had to live with that truth by self. no one else would beleive me showing the letter to everyone dosent take away the pain i felt and the finacial burdens i had to deal with this extra money was taken form me. arent they responsible and i get county of Los Angeles to pay me back for their error in overcharging me? please help me

Re: child support

Based upon the concept of "sovereign immunity", you probably can't go after the county for emotional distress.

But, if they now say that the audit of the account shows overpayment, call the department who sent you the letter and ask how to get your money back.

Good Luck
