Legal Question in Family Law in California

child support when parentity is not verified

I live in PA work in MD and may have had a child with a woman I met over the internetin CA. We have never lived together only visits. I received a letter from child services that they are requesting information form my employer as to my pay to take child support payments. I have been told by a lawyer that they can not do anything to proof of parentity is established. So how can they do this? Yes I was stupid and it may be my child, but I was used for support money. How much can they take from me? We have never lived together and I have never supported her in any way. Yes she is a crack person that usually doesn't have a job and when she does it work under the table. Do I have any recourse, since everyone seems to take it upon themselves to just assume I am the father. I have already informed the child services I don't know I am and also the mother. She is very sexually active. Any comments or help would be greatly appreciated.

You asked about child support.

You need to engage an attorney immediately, in California.

Child support is enforced state by state. If the woman identified you as the father on the birth certificate then the burden is on you to prove that you are not the father.

Support isn't taken from an employer until fairly far along in the process, meaning you have not made payments that have been ordered. As to amount it is set by state as a percentage of your pre-tax wages, less certain amounts.

The attorney in California can advise you better but if the mother is an addict as you suggest then that can get the child removed from her care. that will do nothing to relieve the support obligation.

I can make recommendations on an attorney if you would like. I would need to know the locality of the child.
