Legal Question in Family Law in California

Child Support Payments

I got back together with my ex-wife and was wondering if the child support payments stop at that time because they told my ex-wife that they were going to close the child support case here in Virginia Beach VA. and i was wondering if that holds true for California as well. My main question is if the payments stop, does the child support owed to date have to be paid back?

Re: Child Support Payments

If there are court orders in effect, those orders remain until such time as you file moving papers with the court and seek an order for the payments to stop. The arrearages must be repaid unless forgiven by the obligee. ( If there was welfare involved, the county of Los Angeles will not forgive the debt.

Re: Child Support Payments

If the order is from California, only the court there has the jurisdictional authority to vacate the order and make rulings as to what may be owed, if anything, for arrearages.

The same applies if the order is from a court in Virginia with payments transmittable to California.

Re: Child Support Payments

If the child support is owed to the county for reimbursement for AFDC paid to mom it would still be owed.
