Child Support Payments

How can I establish child support for 2 children? (7 and 3 years old) I do not have an order for child support, I am trying to establish one. What are my rights as the 'constodial parent', the Non-constodial parent doesnt want to pay for anything. He hasnt payed child support-ever. He wants visitation rights, but refuses to pay child support. Can he legally have rights to see them if he dosent pay child support?

I assume that you were not married to the father. You need to file a paternity action to establish paternity, child support and child sharing. There is no legal connection between child support and child sharing and so even withholding the children from him because he will not pay support will be a negative in the eyes of the court. Start the action immediately. It is the in best interest of everyone, particularly the children. You will find that the procedures are much easier than you think and you will be glag that the matter is taken care of rather than hanging.
