child support percentage

my ex-husband has custody of our 3 cildren ages 10, 6 and 7. He is on welfare. i have been ordered to pay approx. 491.00 per month. I will be starting a retail job soon at 6.75 per hour at about 25 hours per week. If all of support is taken out of check that leaves me about 8.00 left over every 2 weeks. Will they take all of the support out or is there a certain percentage that they usually use? what is that percent?

The wage assignment can take up to 50% of the after tax income or with a court order 75%. You should file a motion to reduce support. There should be a family law clinic that can assist you or legal aid to assist you in preparing the required papers for the motion. Act quickly as the accrued support cannot be modified. Based on the amount of income you have state you have the amount of child support should be lower. Your immediate response to theis situation may save ou several thousand dollars.
