Legal Question in Family Law in California
Child Support & Proof of Income from personal business
My husband owns a personal business. He has an open child support case in Alameda County in Oakland, CA. He doesn't have a lawyer to represent him.
1. The custodial parent of his daughter and her lawyer are requesting for a copy of his customers' names, addresses, phone numbers, and receipts. Is it mandatory for him to provide all of this information? If not, then which ones are mandatory? Are their any laws that I can reference?
2. Is it mandatory that he shows proof of my income? Is it mandatory that he has to state my income?

It is not "mandatory", but the consequences are usually more severe if he does not produce the info; meaning that his support obligation may go up substantially. Also, you do not have to provide any income info to anyone, even your husband. However, if your employment records are subpoenaed, you will need to file a motion to quash.

Depending upon the type of business he may be able to either prohibit disclosure of the list or severely limit its use. Unless he is able to get an agreement from her attorney regarding these documents then he must file a motion with the court limiting the extent of the discovery request. Ignoring a discovery request as stated by other attorney can be very devastating.
