Legal Question in Family Law in California

when child support was put in to place over 5 years ago, I was working earning around $40000 to $45000 per year. for the past year I have been unemployed getting only a unemployment check, which is a lot less than I was earning prior. are these terms to reduce my monthly child support payment of $430???

I all other factors are the same, a reduction in income will result in a reduction of child support.

Yes, but not until you file a motion to modify support. The court can order the change retroactive to your filing date only.

contact the child support services department in your county and ask for a review of the amount based on your new income. You will have to provide a lot of info regarding your income and expenses but they will not charge you attorney fees. You will have to keep after them as they have a huge case load so remind them often that you need help. If they move too slow, get help from the self help desk in your county court or hire an attorney.
