Legal Question in Family Law in California

child support

I have recently received a change in a child support judgement. The mother's gross monthly income was reduced by a $750./month amount designated ''health insurance costs''. It is a fact that only $250./month of this amount goes toward covering 2 monor children on the mother's COBRA health insurance policy. Can the entire $750. amount be deducted from her calculated monthly income or should only the amount paid for the children ($250.) be deducted? Thank you.

Re: child support

Payments for health insurance are not deducted directly from her income. There is a provision for the amount of insurance premium to be entered into the child support program. The result is generally much less than if the premium was deducted from the gross income. Her payment for the health insurance for herself is a cost that is normally included in the calculation.
