Child Support Recipient

We already have a child support order in place and are finalizing our divorce. I did not request, nor do I recieve alamony. The judge stated that the last thing we need to do is submit an income and expense declaration, but now I make almost triple what he makes. Will they decrease the amount of child support that he is paying. (His circumstances and income have not changed).

Not only might the child support he pays go down it is possible that you would have to pay him child support. Child support is determined by the use of a computer program. This program uses dad's income, mom's income, and the per cent of time the child(ren) is with each parent. There are a few items that can be deducted from the income. These items generally result in only a small change in the amount of support paid. The amount of time the child is with each parent has the greatest change on child support. The only way to determine how child support will change is to put the data for your case into the program and run it. Generally family courts have a copy of the program available for the use of attorneys and parents to calculate child support payments. Consulting an attorney regarding your situation would be advisable and may save you some money.
