Legal Question in Family Law in California

child support reduction

Barring any changes in either parties

income, is it possible to get a

reduction in child support based on

child's age?

When divorce was finalized, daughter

(age 14 1/2) payment was $800,

son (age 9 1/2) was $1200.

Daughter is now 19 and support has

ended. Son is now 14 1/2 and

support is same.

Re: child support reduction

Child support is calculated by formula and age is not a factor in the formula. You should talk to a child support attorney before you file a motion to reduce the support and then fine out that your child support is going to increase. I've set in court many time and watched as people representing themselves ask for a support reduction only to see the support increase. The attorney's in the courtroom roll their eyes because some poor guy or gal is making a big mistake. Good Luck, Pat McCrary
