Legal Question in Family Law in California

Child Support Reduction

My soon to be husband has been paying child support for 6 years. All of the children are of grade school age or older. His Ex-wife just graduated with a BA in education and is qualified to be a teacher. She has never worked or contributed financially to the childrens upbringing. At the time of the support hearing years ago- visitation rights were set as to when she said it was OK and when his job would allow. He only has the children about 10% of the time. The other 90% they are with the mother. I have looked at the forms needed to show cause for a reduction in support but find them somewhat confusing and feel they do not take into account other circumstances. We would like to re-establish the support financially as well as have scheuled visitation of the children every other weekend and other vacation times. What is the best way to begin the process. Any advice will be appreciated.

Re: Child Support Reduction

Before your husband files a motion he should talk to a family law attorney who can calculate guideline child support and advise him how to proceed on the child sharing issues. Child support is calculated by a formula and I have been in court on numerous occasions when a party representing themselves ask the court for a decrease in support and the court increased support because of the mandatory formula.
