Legal Question in Family Law in California

child support requrements for high school student

My son, 18, is a high school senior and may be the father of a baby. If it is proven so, could he be responsible for child support payments while still in school? Also, would the payments be retroactive to the date the baby was born? The mother claims not to be concerned with a paternity test at this time. In addition, the baby was born in Idaho, but mom & baby moved to California the next day. Does this make a difference?

Re: child support requrements for high school student

In California child support can be collected for the welfare payments she receives. The county can go back 3 years to collect. The amount he owes would be based on his income at the time. If he lived in Idaho when the child was born and still resides there then child support would be cased on Idaho child support laws.
