Child Support
I separated (non-legal) in 4/2000, because of legal ignorance, my wife and I did not get our hearing until 12/2000. Is there a case law that states I have to pay child support prior 12/00 that I can present on our next hearing date of 3/18/02. Retro support is one of the issues that will be heard amongst division of debt/assets. I do not feel I owe prior because I was not allowed to see my children because of waring parents, childish I know but fact just the same. Please help!!!!

We don't have sufficient information to give you good advice. Generally, child support will not be awarded retroactive unless a motion has been filed for the child support. Also, there may be some issues of estoppel to prevent collection of child support, but that is difficult to prove, since you have the courts available to you to resolve the problems. You should seek the advice of an attorney who can question you more in depth to get a clear understanding of rights and obligations. Good Luck, Pat McCrary
