Legal Question in Family Law in California

Child Support Services

I fell behind towards the end of 2008 because my hours were cut do to the slow economy. I fell behind a couple months, since then I have paid the mother all child support payments, as I am current. Now she reports me to Child Support Services saying that I am behind. She filed the case back in March. I filed to take her to court to remove the wage garnishment because I have always paid her and I am current. She is only doing this because I have taken her to court because she has violated the court order on numerous occassions. Its obvious that she is doing this because she is upset that I enforced my rights as a father. I also found out that she was receiving medi-cal when I was supplying health care for our child, she refused to use my health care for our child, and she was working full time and she had an HMO through her employeer and did not get health care for our son. What do I do to stop her from making false claims against me? How do I stop the garnishment? And, what are my options because this is getting out of hand?

Re: Child Support Services

You can't stop the garnishment or enforcement through the Dept of Child Support Services, she has a right to do that. To the extent she is violating court orders and making problems, you can seek appropriate remedies from the court, which may be contempt, an award of money for costs incurred, etc.
