Legal Question in Family Law in California

Child Support and Sole Custody...

Hello,

I am 17 and currently 6 months pregnant.

The father is not a good guy at all.

He sells/uses many drugs, lies constantly,

and will only cause harm to my unborn baby's life if he is allowed to see him.

My question is this:

Can I get sole custody of the baby, but still have him pay child support every month?

He is also supposed to be getting over $100,000 in inheritance money in April of 2002, is there any way I can have some of that money for my baby?

Please help me...

Thank you,

Jennifer

Re: Child Support and Sole Custody...

You will need to go to court and show the judge that he is an unfit parent and any type of contact with the child would not be in the child's best interest. Bring all evidence you have of his drug use and/or criminal record to court. It is up to the court whether or not to allow him contact with the child. As far as child support, the court will compare his income to yours and order the determined amount. The inheritance money is his, but if he fails to pay child support the DA's office will garnish his wages and his inheritance money to pay it.

Yes, custody and support are separate issues. No, you dont get inheritance money but he will have to use some of it to pay support.
