Legal Question in Family Law in California

Child Support

My son was placed into a juvenile facility when he was 18 years old, and he was there for approximately 5-6 months. I was recently informed that I have been sued by the County of San Diego for retroactive child support payments that I owe for him that cover the period during which he was in the facility. The payments are allegedly for public assistance that was provided to my son during the period in question. I was never made aware of this financial obligation. My wages are now being garnished to pay off this debt. What can I do to remedy this situation?

Re: Child Support

It sounds like you have been sued and a judgment has been entered. Being is a juvenile facility is receiving public assistance. You should be paying the support for that period of time based upon your earnings. Have the judgment reviewed by a family law attorney to make sure you are paying the right amount. Do not go to the DA first or file a motion without talking to an attorney, you could end up paying more than what is already ordered. Depending on your income, you could end up paying less. Get some good advice. Good Luck, Pat McCrary
