Child Support & spousal support
My husband and I would have celebrated out 25th anniversary this year. On Sunday, May 30 he said he wanted to separate. On Tuesday he bought a new car and emptied our savings. He refuses to go to a marriage counselor. We have a 15 year old daugther. What are my rights. Mr husband is the Director of ICU (he is a RN) I am a new RN and I make 75000/yr, he makes 103,000/yr. WHat will I received from him.

Your statement of facts raised only two issues which can be partially addressed. I would expect that the court will order him to pay you one half of money he took from the savings account, and the car payment would go with the car to him. As for child support based on your income, his income and 20% visitation child support would be about $800 per month. The actual amount of child support could vary considerably from that amount once all of the pertinent information is obtained and put into the calculation. After essentially 25 years of marriage I would expect that there is little if any separate property owned by either of you. discussing the facts of your case with an attorney would be a prudent investment of money.
