Legal Question in Family Law in California
Child support
My spouses ex-wife is asking for an increase of child support. My husband and I are the sole support for my children from a previous marriage. Will my new husband's income be considered as the support since their biological father does not pay child support and is a dead beat dad.

Re: Child support
Yes, it will. The point is that your children are not the responsibility of your new husband. The dead-beat dad is responsible for them. It is not fair to your new husband's children to say that he cannot support him because he is supporting your children from a previous marriage, when their dad is actually responsible for their support.
Re: Child support
It will be considered only if you request the court to take into consideration any hardships you have, i.e. your husband's children.
