child support and tax deductions

My husband was just ordered to pay child support of $600 a month. If he takes the mother to court and gets joint legal custody can twe apply for the earned income tax credit?

You need to ask your tax preparer. I'm not sure, but I think you need to have the child's mother waive her right to claim him as a dependent. Check with your tax preparer or the IRS.
