Legal Question in Family Law in California

Child Support after child turned 18

My son is 18 and has been in police custody and or rehab law required, I have been paying child support, and now there are court fees to be payed for him! My ? is should my child support have gone to him to pay for the rhab since they were careing for him, in which we have to pay for him to be in there plus jv time in there facility. Instead his mother used on herself since he was not around, and she put my name on all the incoming bills so I am the one who gets to be in debt even though we have to split half of all medical expences if not picked up by my insurance. He missed graduating and now will not until December2009 so I endup paying for a whole other year $700 a month and I have a family to take care a young son. Also he have a job his mom got him a job at her work. Well if you have a answer to what I should do I would appreicate it!!

Re: Child Support after child turned 18

You are not responsible for paying child support to the mom during periods of time she does not have custody, although you may be responsible for paying support to the person who does have custody. You are not required to pay double support. So, it sounds like the mother owes you a refund. Also, it sounds like you may have a case of identity theft against the mother. This is a crime, for which she can be prosecuted and spend time in jail. So, you also have a lawsuit against her for using your name without your knowledge or permission. You also may be able to lower your continuing child support obligation.
