Legal Question in Family Law in California

Child Support - unemployed ex-husband

My ex husband just informed me that he lost his job. He was making 70K + per year - his current wife makes 125K+ per year, they have a two year old. I have a 15 year old and make 33K. I live in WA, he lives in CA. He has not been paying his full child support because he claimed ''hardship''. He has said he will no longer pay for insurance for daughter (mandated by decree) and wants his child support refigured for 1800/month that he figures he will get after taxes on unemployment.

What do I do? Can he still pay more than on his unemployment? He has savings, a home, etc...

Re: Child Support - unemployed ex-husband

He cannot unilaterally decide to stop paying support. The support will continue to accrue as well as interest on the unpaid amount. Intererst is 10% per annum. The only way for him to stop or reduce the support is by way of a court order.

If he has savings, etc., you can enforce your support order.

I am an attorney who has been enforcing support orders for over 20 years. I would welcome the opportunity to discuss this with you at your convenience.
