Legal Question in Family Law in California
child support during unemployment
I had my divorced settled in court with child support and spousal support. Now I have been unemployed for more than on year. I have two questions: 1) Am I still responsible for paying support during th eunemployed period?
2) I f i get a job again and my salary is much lower than the one when I settle the case in court, will the amount be reduced and does it have to go through court a gain or can be done by opening a case with child support division to make adjusment?
Best regards

Re: child support during unemployment
You will be responsible for support at the old order until you modify that support order, regardless of your earnings. You have a right to modify the order since your income has been reduced. You need to file a motion to modify, immediately! If your court has a facilitator's office they can assist you with the forms. Go down today. Good Luck, Pat McCrary

You have the responsibility of going to court and asking for a modification of support, based upon your changed circumstances.
I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
