Legal Question in Family Law in California

child support & wage assignment

my husband went to court in march and we modified child support. we had to wait for the judge to make a final judgement on the child support, so we didnt get to hear it in court. well now she has it in the minutes that my husband has to pay child support payable by wage assignment.

we have always paid by personel check. should we still keep paying the ex until the wage assignment is filed?

Re: child support & wage assignment

Yes you owe the support whether or not there is a wage assignment in place. Once the wage assignement is served on your employer and the employer starts taking out money you no longer have to make the payments to her.

There is some delay in getting the support once the wage assignment is served on the employer.
