Legal Question in Family Law in California

child support wage garnishment and custody

my boyfriend's children have been living with us for the last year. his wages were garnished for back support for the same children. we have filled out an income and expense declaration, an application for stay of service of the wage assignment, a request for review and modification and furnished these along with proof the children are here to the district attorney's office. how long can we expect to wait for something to happen? should we file these papers with the court or will the D.A. do this?

NOW, IN RESPONSE TO YOUR INQUIRY --

The DA (now Department of Child Support Services) MAY respond to you package but most likely will not file the papers with the court. How long depends on which county. Plan on several months if ever. If you want this taken care of promptly, contact an experienced Family Law attorney in the county where the action took place and/or where the order originated for specific advice and possible representation on your behalf.

Thanks for sharing your interesting inquiry, and good luck with your case.
