child support and welfare assistance

the mother of my three children was recently laid off from her job and will try to collect welfare assistance. we are currently in the process of getting a ordered amount of child support and have already filed with the court. The order will include paying back for state assistance she recieved 7 yrs ago for our oldest son. I was wondering if she receives assistance now will I have to pay it back also? I am paying her child support now with out the court order. Will that matter?

The court will determine how much child support you should pay based on your income, her income, which should include unemployment compensation, visitation and other factors. This support is paid to the county. The county deducts the amount of state assistance and pays the remainder to her.
