Legal Question in Family Law in California

child support

i will be getting married soon and my fiance pays child-supoort to

the ex. Once we get married, does the ex have any right to

increase child support based on both our incomes? My

understanding is that once child supoort is set tand the person

remarries the partners income is not worked into the partners child

support factor.

Re: child support

California law prohibits the use of new spouse income in calculating child support. Your income will used for the sole purpose of determining the amount of income taxes paid by your spouse. Taking your income into consideration for taxes may actually reduce the amount of child support paid as he may be in a higher tax bracket and would pay higher income taxes. You should consider consulting with an attorney regarding what to expect and to do to protect yourself.
