Legal Question in Family Law in California
Child Support? Will I win? Custody issues.
I have a soon to be 3 yr old with my ex boyfriend. I left him and my son for one year to live in a different county, only because I was in a unhealthy relationship with my sons father at the time. Now I've moved back and my son stays with me. I don't work but I go to school fulltime. My parents help out a lot. My question is, if I file for child support, will I be able to get it? Regardless, if I left my son for no more than one year. And if I am able to get child support, is it possible that his father could take me to court for custody issues? And will he be able to win custody battle because he has a job and he will most def. bring up the fact that I left my son (but was only because the relationship was unhealthy for me).

If you request child support he will very probably request visitation. The more time the child is with him the lower his child support payment will be. Therefore he has a vested interest in having the most time he has the child with him. Every custody and visitation case has risk and are hard to predict the outcome.
