Legal Question in Family Law in California

child support for 20 year old

Dear madam, dear sir

20 years ago i gave birth to a child whos father was and is in the us military (now reserve)in germany.he chose to leave the child and i to continue his career in the military, he was military inteligence and not allowed to have close contact with germans.i provided the german government with his name and address and they then contacted the us army to collect child support.the us army wrote a letter stating that they wont give out his addres and that was that. i had no rights to fight for my sons right to be supported by his father. i basigly raised him by myself. since march of this year i am a resident of the usa and i was wondering if there are any options for me or him, since he is 20 now, to find out his fathers address and file for payment for his college or any payment. i do have some papers which were given to tm from the government which show that we could not go through with the child support. now that i am a resident do i have any change to provide my son with what he deserves?

Thank you so much for your help.

Re: child support for 20 year old

I am afraid you are out of luck. In California, the court has no power to order child support unless a petition is filed. Family Code Section 4009 then allows a court to make the order retroactive only to the date the petition is filed. Therefore, you cannot collect any child support from your son's father.

Since you live in Florida, you might want to ask a Florida family attorney whether there is anything their courts can do for you.

On the other issue of college tutition, you of course can ask his father if he is willing to contribute, but there is no law requiring him to do so.
