Legal Question in Family Law in California

child support of 16 yr old daughter

my ex-husband has been unemployed for years, actual custody shifted from 70/30 to full time with me almost 2 years ago, my income has significantly declined in the past 2 1/2 years.

My ex-husband started a new ''great job'' last week, but will not provide specific information for recalculation of child support.

Does he have to be employed for a certain length of time before I proceed? I believe this is an something I can pursue without legal expense by using the court system. Is that correct?

There is no specific time that he must work before child support can be changed. The real question is the probable length of the employment. If this appears to be a permanent job, you can immediately commence a motion to modify support. You can get help with this process from the department of child support services. You also have the option of acting as your own attorney.
