Legal Question in Family Law in California

Child Support-California

I owe a large sum of money (approx. 158,000+interest of 151,000=309,000) for child support arrearages. I am 53 yrs old and am currently receiving disability. Child support takes money from each of my disability checks for payment on arrears owed. I had a stroke a few months ago which caused some memory loss and at that time my brother and I opened a bank account together so he could help me out with my bills etc., The other day I went to the bank and was told I had no money left in this account and that Child Support had taken everything I had! I have no way to pay my bills and all the checks I had written for utilities, rent, etc. are all bouncing which is costing me a fortune and I have nothing! This was not only my money, my brothers was in there also! It doesn't look like I will ever be able to go back to work, (memory) and at my age I will never be able to pay them off. What are my legal rights? They have left me with no way to live. How can I get my $ back or atleast part.

Re: Child Support-California

Child support enforcement is an unsympathetic process. How did you end up owing such a large sum if you never had any money? That can't happen without a huge mistake: the government's or yours. For that amount to accrue, fixing that mistake seems unlikely because too much time must have past (I don't say it's impossible).

You can't have joint accounts with anyone, the authorities are onto you. I know of know way for you to get the monies back. Child support enforcement doesn't care about you, even if your kid(s) are healthy and wealthy adults. They keep going. Sorry.
