Legal Question in Family Law in California

child support/tax info

I have received a paper saying I owe child support, I have no children. They want to take it out my his tax returns. Me and my father have the same name and my father owes child support. Can they have gotten us confused? If so how do I fix the situation?

Contact the agency that is attaching your income tax refund and tell them that they have the wrong person. Then ask what evidence you need to provide to convince them that you are not the person that owes child support. If that fails then consult with an attorney to get help filing the appropriate paperwork to get a court order that you are not the person that owes child support.

Were you ever given notice of a hearing? If not you might want to file a motion for recosideration. They cannot order you to pay without first establishing paternity. If they gave you notice, but you failed to appear they could have established paternity by default.
