Legal Question in Family Law in California

Child Suppport from Ex with Whom I Share Equal Custody?

My ex and I have a son with whom we share equal custody - every other week as opposed to me during the week, him weekends, etc. This was not court-ordered but what we verbally decided on because we felt it was 'fair'. I've been told my ex should actually be paying me child support, which didn't occur to me as we share our son equally. We were never married and he's never been able to hold a job more than a month or so (the rare times he had a job, anyway). Should I be getting child support from him anyway?

Child support is based on a number of factors. The three major factors are dad's income; mom's income; and the amount of time the child is with each parent. Since he is rarely employed and you are employed you could have to pay him child support. You should consult with the family law clinic or an attorney to get a better feel for the child support situation.
