Legal Question in Family Law in California
want to take our child on vacation oversees, boyfriend will now allow
My boyfriend of 8 years and I have a 3 � year old daughter. I have family and friends oversees specifically in Eastern Europe, Italy and Spain that I would like to visit and introduce our daughter. My family really would like to see my daughter; however my boyfriend does not seem to want to go oversees. I even offered to pay for all three tickets, but he is very resistant. I suggested that my daughter and I go alone for one week, but he does not want to hear of it. I am unable to obtain a passport for my daughter without his permission/signature. I have lived here practically all my life and I am an American Citizen. What rights do I have?

You have to file a Complaint To Establish Parentage before you can file a motion. This is the only way to open a case in Family Law when you are not married. The court may then make orders for custody and visitation. You would be asking specifically for permission to obtain a passport and take the child for a vacation in Europe. If you fail to return to the US you could loose custody and the child's father could pick-up the child and bring her back to California.
