Legal Question in Family Law in California

child visitation

My ex decided to move a couple of hours away and now wants me to drive every other weekend to pick up my kids. It will be a minimum of 4 hours in the car for me to pick them up but when he picks them up from me he can do it on company time in his company car. Can I refuse to drive the whole way? Can I get reimbursed for mileage?

You should file a motion to modify the current child sharing schedule and have the judge determine the transportaion arrangements. The issue of costs of transportation would be brought up in a child support hearing if you wanted to open that issue. I suggest that you get an attorney who practices in front of the judge that you will be dealing with. He can give you some practical advice. Good Luck, Pat McCrary
