Child Visitation

Hello, I am currently going through a divorce and i am fighting for roughly 30% visitation time with my children. If I get this and my children are with me for a long period of time (30 days or so) how old can they be to share a room if they are of opposite sex's. 5yr old girl, and 3yr old boy, 1yr old boy. The youngest will stay with me in a crib until older but, I am curious if the other two have to have their own room due to their ages. I currently have a 2 bedroom apt and cant really afford a 3 bedroom apt with the amount of child support I am paying. thank you for your help.

Your financial circumstances and the sleeping arrangements are not unusual. It is possible that a judge could consider that not the best circumstance, as it is a matter of the judges descretion, not law. Most judges would consider it more important to see that you have valuable and substantial time with the children than their sleeping arrangements. Good Luck, Pat McCrary

Because you are fighting for custody/visitation of your children I would strongly advise that you retain an attorney to help you.

The issue of sleeping arrangements are taken on a case-by-case basis and the court will look to the reasonableness of the accommodation. If there is an attorney on the other side you should know that he/she probably will argue that your accommodation is inadequate - hence the statement at the beginning - retain an attorney if you can.
