Can child visitation be taken away because of a 11550 Under the influnce of a controled substance

The police came into my home with a search warrent for drugs because of the person I was renting a room to. They found nothing but I was arrested for under the influnce and my exwife had to come pick up my 2 boys age 7 and 9. Now my exwife is saying that I can not see my kids and has filed somekind of paperwork I have yet see. Is it possible to get an emergancy order saying I can not see my kids. We already have a visitation order.

Yes, in a situation like yours Child Protective Services will often insist that mother, protect the children from exposure to your drug use and apply for an emergency order that she have custody pending a hearing. If your relationship with the children is important to you, you need to become clean and sober. You will have a lot of hoops to jump through over a long period of time. Your willingness and ability to comply, will determine your future visitation with the children. You perhaps already have a criminal attorney, you should also have a family law attorney, if you don't already have one.
