Legal Question in Family Law in California

Child Visitation Modification

In advance, thank you for all your assistance. I shared legal/physical custody of my 13-yr old daughter. Mom filed OSC to reduce my visitation time, mom stated that my daughter is willing to talk to the judge, since she's already 13years old. I don't want to reduce my visitation time; mother forged and gave misgiving info on the proof of service by mail. Mom has been in contempt of court order by taking our daughter out of the country without my written permssion (as stated on current court order). I have proof (pictures, school attendance report, our daughter has confirmed many times). Also mom knew about our daughter opening a myspacecom accout, posing as a 17year-old when she's was only 12 years old. Also, mom has let our daughter stole money from the school's fundraiser. I filed a police report in '06 when I went to pick up my daughter and she was not @ home. Mom is adamant in reducing my visitation time stating that our daughter wants to spend more time w/ me. Mom has used parental alienation. we are going to mediation this week and I'm not planning to change my visititation, our hearing date is next week. I know my daughter is scare of her mom and most likely doesn't want her mom to get hurt. PLEASE HELP, thank you.

Re: Child Visitation Modification

Depending on the Court, there may be a minor's counsel appointed for the child. You may ask for an pay for a child custody evaluation (either through the Conciliation Court or private for mucho $$$) Most Judges will not interview the child, but there are exceptions
