Legal Question in Family Law in California

child visitation / support

I filed for child support back in 1996.. Pregnant..no means of anyting...baby father been in prison ever since i wwas pregnant. All these years pass and all of a suddden i get child support checks! well i calld and the state found him. owes arears of $56k. Child support rep asked me do i want to open a CURRENT case for child support for thepresent time. what if he wants to see her. Thehy have never met. My daughter 12. If I asked for more money, what if we go tto court, and he says something like ''well I am not paying for a child I dont see!'' and demands some visitation or custody. Would a judge let a 12 year old girl go with her father whom she has never met and is a convicted felon? Has done over 13 years all together. Or should I leave it alone and take what I have right now? HELP! ---oh! we were never married!

You need to discuss this with an attorney. There are a number of facts which need to be reviewed before a decision can be made. For example what was the offense that he was convicted and set to prison.
