Children
My daughter is seperated (not legally) from her husband. He is not a citizen yet. She wants to move to Colorado w/their 2 daughters. There are no legal custody agreements as of yet. If she leaves without his permission can she be charged w/kidnapping?

She could, but there is always the risk that he could go to court and ask the court to make her bring them back. It would be better to go to court and get custody and ask permission to move.
