am i able to take my children to another state there is no custody through the courts and there is a history of reported domestic abuse. Abuser is the father. Mother is trying to leave with the kids.

While not illegal, the courts do not like parents who take the children out of state away from the other parent. The California courts have jurisdiction over the children for six months after a move-away. If the father files for custody within those six months, you will have to appear before a California judge who will be very displeased that you did not come to court before the move and obtain appropriate orders for custody, residency and visitation. If you have a good case for DV limitiations on father's custody or visitation rights, get that case turned into a favorable order and then move.
