Legal Question in Family Law in California

childrens court dependency issue

My son didn't want to leave the beach, pulled him by the arm to get him into car and was screaming at him which drew too much attention. Some people called the p.d. who saw a couple of scratches on my son's arm. Got a misdemeanor charge and there was a petition filed in children's dependency court the next day. I think the proceeding was called a detention hearing. The children svc people wrote a laundry list of stuff against me claiming that I hit my son all the time, that he is in danger around me and that I must have dpss monitored visits. It was ordered I get a 730 exam, take parenting and anger management classes. I go back to court on 10/17/07. What are they trying to do to me, to my son, my family???

Re: childrens court dependency issue

The social services have alleged that you have abused your child. The program that they want to follow is to put you through the paces before your child is returned. You should consult with an attorney with experience in child dependency court. Based on your statement you may have a defense. Start a parenting class immediately. The purpose of this class is to improve your parenting skills. It is not an admission of any wrongful conduct by you. It is merely a step toward improving your parenting skills. You may be able to convince the court that if there was a problem that it no longer exists. The court appointed attorneys often just want you to submit and then work on reunification.

I am sorry to hear of this very distressing matter. What county are you in? Has your son been removed from your home? There should be a reunification plan that you must adhere to. Contact me directly.
