Legal Question in Family Law in California

My childrens father has been the custodial parent since January 2013. He is now beginning a job which will require the children be with a nanny from 4am-5pm. I want to ask the court for custody back, but wealready have a pre trial settlement conference scheduled for August 28th.He begins work Aug 15th. Can I file a motion to prevent this before the pre trial settlement conference? Also it states in the court order that we have to agree on things like medical, childcare, education. Me

You can always file a motion (Request for Order) to modify custody. In addition, you should file a Settlement Conference brief (may be required already, along with Declaration Regarding Declarations of Disclosure, Property Declaration etc) You want to make sure that if trial occurs before the Request for Order is heard, that the court and the other side know that Custody and Visitation is an issue.
