childs name chage

i would like to leagally change my sons middle name and last name. his father is incarcerated for sex crimes and i dont want him to know where we live. i also want all parental rights taken from him. can i do this without him finding us?

Depending upon the facts of your case you may be able to accomplish the name change without divulging your address. If you or your child was victim of father's conduct you should be able to get a court order keeping your address confidential. Terminating his parental rights is less likely to be accomplished. You may be able to get an order that he is to have no contact with the child.

The Court will grant your petition to change your son's name if the court believes it is in the best interest of the child taking into consideration the importance of the father-child relationship, the importance of a child's need for a family-ancestral line, etc. You will only get a court order to hide the child's address if you can prove to the court that the father is dangerous to the child which will require more than your word alone. You should take witnesses into court.
