Legal Question in Family Law in California

In the child's best interest

I'm currently in a child custody case in California, but residing in Arkansas. Right now there is a temp. court order for my child, who will be 2 in Feb. to visit his father for a 2 week span about every 2 months. After his 1st visit w/ the father my son has come back slightly confused. I have no problem w/ the father visiting the child. Are there any judicial cases I could point out to the judge to show that although the child needs to visit with the father, he shouldn't have to be uprooted from the primary care-giver until the child reaches a different age?

Re: In the child's best interest

Unfortunately there are no cases I am aware of that apply to this case. Your best option is to have you child evaluated by a therapist regarding the adverse affect that these visits have on your child. Then file a petition for a change of visitation.

You should also check with an attorney in Arkansas regarding the possibility of obtaining an order in Arkansas modifying the visitation order.
